Guilt and Denial May Have Caused Foreclosures

February 11, 2009

Atty. April Charney, a Jacksonville Area Legal Aid Attorney, said that people who are facing foreclosure problems are in denial and feel guilty about their situation. Charney said that such feelings worsen their situation as this result to non-action.

Similar to being diagnosed with a fatal disease, facing the risk of having a foreclosed home causes the homeowner to be in denial. When a homeowner is in such a state or feeling, the most possible situation is to do nothing about it. People would go on their lives doing their jobs and coming home, placing the foreclosure issue at the back of their heads.

Another feeling associated with having repossessed houses is guilt. According to Charney, who is a renowned specialist in foreclosure prevention in the whole country, most homeowners feel guilty about not being able to pay their mortgages. Since the home symbolizes their status, capability and sense of responsibility, losing it also means losing their abilities to fulfill their obligations to their families.

With the increased number of foreclosure properties in the past year, more and more people are being aware of the situation. Charney encourages threatened homeowners to be more aware of their situation and act on it immediately. Foreclosure can be prevented with the right measures coupled with the right knowledge on things.

A recent foreclosure summit held in Jacksonville had attorneys, civic leaders and non profit organizations talk about how to deal with foreclosures. Primarily, people should not allow guilt and denial to hinder them from acting on their situation.

Immediate action is important to prevent foreclosure. Deciding to act on foreclosure after a summary final judgment is released is not wise. At this point, the situation is already irreversible. Homeowners should be proactive in keeping their homes, as they have very big chances of keeping their properties if they act accordingly ahead of time.

Charney, along with other foreclosure attorneys such as Chip Parker, are also working on having more lawyers who are trained to handle foreclosures. Charney further stressed that foreclosure does not just affect a single homeowner, but a whole community. It is therefore important to take the necessary actions to prevent more foreclosures from happening.
